Terms of Service

These Terms of Service (“Terms”) are an agreement between you and GoLocal LLC, a California limited liability company (“GoLocal,” “we,” “us”). They cover your use of the GoLocal mobile app and the website at golocalexperiences.com (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Services.

1. Who can use GoLocal

You must be at least 13 years old to use GoLocal. If you are under 18, you may use GoLocal only with the permission of a parent or legal guardian who agrees to these Terms for you. You may not use GoLocal if we’ve previously banned you or if the law doesn’t allow it.

2. Your account

Give us accurate information when you sign up, and keep it up to date. You’re responsible for keeping your sign-in details secure and for activity on your account. Tell us right away at support@golocalexperiences.com if you think someone else has accessed it. You can delete your account at any time in the app (Profile → Delete Account).

3. What GoLocal is (and isn’t)

GoLocal is a discovery and social service for local experiences. Listings may come from our users, our team, or third-party sources such as Google Places and tour and activity partners. We don’t own or run the places and events listed. We aren’t a party to any purchase, booking, or visit you make, and we don’t guarantee that listing details are accurate or up to date. These details include hours, prices, availability, and safety. Always check with the business before you go. If you follow a link to a third-party site or booking service, that third party’s terms apply.

4. Your content

You own the photos, videos, text, and other content you post (“Your Content”). To run the Services, you give GoLocal a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify (for example, resize or reformat), publicly display, and distribute Your Content. This covers operating, promoting, and improving the Services. The license ends when you delete Your Content or your account, except:

  • for copies held for a limited time in backups;
  • where we’ve already used Your Content in promotional materials; or
  • where the law requires us to keep it.

When you post content, you promise that:

  • you have the rights needed to post it and grant this license; and
  • it doesn’t violate these Terms, the law, or anyone else’s rights, including privacy and publicity rights.

We may review, moderate, decline, or remove content at our discretion. Submitted experiences and posts may need approval before they appear publicly.

5. Community rules

Don’t use GoLocal to:

  • post content that is illegal, hateful, harassing, threatening, sexually explicit, or graphically violent;
  • bully, intimidate, or impersonate anyone, or post someone’s private information without consent;
  • post content that exploits or endangers minors in any way;
  • post false or misleading listings or reviews, or reviews you were paid for without disclosing it;
  • infringe anyone’s copyright, trademark, or other rights;
  • spam, advertise without permission, or run scams;
  • promote illegal activity, dangerous acts, or the sale of regulated goods;
  • scrape, crawl, or collect data from the Services without our written permission;
  • reverse engineer the Services, except where the law allows it;
  • interfere with or disrupt the Services, or get around our security measures; or
  • help or encourage anyone else to do any of these things.

If you see content or behavior that breaks these rules, report it to us at support@golocalexperiences.com. We review reports and may remove content and suspend or terminate accounts that violate these Terms.

6. Copyright complaints

If you believe content on GoLocal infringes your copyright, send a notice to support@golocalexperiences.com that includes:

  • your contact information;
  • a description of the copyrighted work;
  • where the material appears on GoLocal;
  • a statement that you have a good-faith belief the use isn’t authorized;
  • a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and
  • your physical or electronic signature.

We may terminate the accounts of repeat infringers.

7. GoLocal’s rights

The Services include our software, design, logos, and the “GoLocal” name. They are owned by GoLocal and our licensors and are protected by law. We give you a personal, revocable, non-exclusive, non-transferable license to use the Services as allowed by these Terms. If you send us feedback or ideas, we may use them without any obligation to you.

8. Suspension and termination

You can stop using GoLocal and delete your account at any time. We may suspend or end your access if:

  • you violate these Terms;
  • we need to in order to protect users or GoLocal; or
  • we stop offering the Services.

Sections 4 (the license for content already used as described there), 6, 7, and 9 through 13 continue to apply after your account ends.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We don’t guarantee that the Services will be uninterrupted, error-free, or secure, or that any listing, review, or user content is accurate. You’re responsible for your own safety when you visit places, attend events, or meet people you find through GoLocal.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, GOLOCAL AND ITS MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. THIS INCLUDES ANY DAMAGES ARISING FROM YOUR VISITS TO PLACES OR EVENTS, OR YOUR DEALINGS WITH OTHER USERS OR BUSINESSES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some places don’t allow these limits, so they may not all apply to you.

11. Indemnity

If someone brings a claim against GoLocal because of Your Content or your violation of these Terms or the law, you agree to cover our resulting losses and reasonable legal costs, to the extent the law allows.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute about these Terms or the Services will be resolved in the state or federal courts located in San Diego County, California, and you and GoLocal consent to their jurisdiction. Before filing a claim, please contact us at support@golocalexperiences.com so we can try to resolve it informally.

13. Apple App Store

If you downloaded GoLocal from Apple’s App Store, these extra terms apply:

  • These Terms are between you and GoLocal only, not Apple.
  • Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
  • GoLocal, not Apple, is responsible for any claims relating to the app. These include product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, and intellectual property infringement claims.
  • You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above. If the changes are significant, we’ll let you know in the app or by email before they take effect. If you keep using the Services after changes take effect, you accept the updated Terms.

15. General

These Terms and our Privacy Policy are the entire agreement between you and GoLocal about the Services. If any part of these Terms can’t be enforced, the rest stays in effect. If we don’t enforce a provision right away, we haven’t waived it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, or sale of assets.
